01 · The use case to start with and the one to defer

High value, available data, no decisions about people

Use case to start with

A customer care and retention assistant for the contact center with the brand’s voice, with a permissioned knowledge base of plans, policies and procedures; an identity adapter for content and promotion with an approval queue.

Use case to defer

Any use of communication or location records, and automated collections or line suspension decisions.

What is already happening in the sector

Large cable and pay-TV operators in Mexico already serve subscribers with generative AI agents, have announced replacing contact centers with foreign cloud platforms, and produce short-form series with AI. All of it on foreign clouds.

What the committee will review

D

Data the first use case touches

Plans, policies, procedures and the brand manual. Subscriber data is consulted with permissions at answer time; article 183 records stay out entirely.

R

Regulator and obligation

The Telecommunications and Broadcasting Law (Official Gazette, July 16, 2025, articles 182 and 183) requires operators to keep 24 months of communication and location records for every line, protected against unlawful access and with no other use, with an express reference to the data protection law. The line registration rules (Official Gazette, December 9, 2025) made each operator the custodian of a registry tied to the national population ID (CURP); in January 2026 the data protection authority opened an investigation into a mobile operator.

03 · Frequently asked questions

What telecom and media leaders ask

What obligations apply to a telecom company in Mexico that uses AI?

There is no AI-specific rule. Articles 182 and 183 of the 2025 law apply (24 months of records under custody, with no other use and communications secrecy), as do the line registration rules and the data protection law. Any system that reads that data must run inside the perimeter, with an audit log the regulator and compliance can read.

Can AI produce content in the brand’s voice without copyright risk?

Work generated solely by a machine has no copyright according to Mexico’s Supreme Court (“Avatar Virtual” case, 2025); the brand is protected by trademark registration and each piece goes through an approval queue with human involvement. The voice and image of performers require prior, written and paid consent (Federal Copyright Law, article 87, Official Gazette, May 14, 2026).
